When Does A 72 Hour Hold End?

Location: Ohio

Patient went into emergency room @ 12:30 a.m. Friday June 13th with suicide ideation. Was pink slipped immediately and detained by security in isolation until later that morning. Transferred to psychiatric hospital @ 10 a.m. Friday June 13th. Intake social worker quit mid-shift and walked out before patient intake was completed. Social worker did not do patient assessment. Patient was told earliest they would be released is Wednesday, if they were not probated before then.

Patient met with psychiatrist on Friday, June 13th, and Monday, June 16th. Neither times were any evaluation papers filled out.

Patient intake assessment was not done until today, June 17th, by another social worker. Assessment finds no reason to believe patient is a danger to themselves. Social worker claims patient is set to be released Friday June 20th. Social worker says they do not have knowledge of when patient was pink slipped and that they could be probated up until discharge. No affidavit has been filed with probate as of this post.

Patient did NOT sign voluntary commitment forms. Patient has NOT been probated.

It was my understanding that Ohio operates under a 72 hour, 3 court day rule from detainment. So, Friday(1), Monday(2), Tuesday(3). Release Wednesday unless probated.

What are the patient's rights, if any, in this situation?
