Wa State — I Contributed Significantly More To Down Payment And Mortgage. How Protected Am I In A Potential Divorce?"
Howdy folks,
Looking for general guidance on Washington State community property law.
My spouse and I purchased a home together. I contributed approximately 4-5x more toward the down payment than my spouse. I also pay approximately 65% more toward the monthly mortgage and household bills.
I have documentation including:
- Closing disclosure showing contributions
- Bank statements showing payment history
- Mortgage payment records
Questions:
- Does Washington community property law consider disproportionate contributions to down payment?
- Can I argue separate property if down payment funds came from pre-marital savings?
- Does ongoing mortgage payment disparity factor into property division?
- What documentation should I gather now to protect myself?
- Has anyone successfully argued for adjusted equity split based on contribution disparity in Washington State?
Not filing for anything currently. Just want to understand my position and protect myself. Our bank accounts are separate. Trying to reconcile a hostile situation, but being prepared at the same time.
