Re Forcing The Sale Of A House

Card image cap

Location: Oregon

A family member passed away and left a house to my spouse and their sibling. My spouse wants to sell the house, the sibling does not - well, not yet anyway. My spouse and I have been maintaining the unoccupied house (i.e., paying the related bills, doing minor maintenance, etc.) and are keen to be free of this responsibility (sibling does not have the spare income to share in the costs) as well as the potential liability risk. We have been told by one attorney that we can pursue litigation against sibling to force the sale of the house. We don't really want to go that route if we can avoid it. Are there any other options? How much would it cost us to pursue this litigation (roughly), and how likely are we to win our case?

Info: if it matters, sibling wants a friend to live in the house short term, which spouse DOES NOT SUPPORT. Said friend cannot commit to any dates (e.g., move in) and has recently had similar plans fall through. Also, spouse does not want the continued financial/liability risk entailed in being a 'landlord' (even by using a property mgmt co.).
