Please Help-- Crippled, Elderly Dad Is Being Denied Ada Accommodation By Employer.

Location: Alabama

Howdy r/legaladvice. I've got a bit of an issue that I was hoping you can help me navigate. My dad is 70 years old. He only has one of his legs. He has worked at Wal-mart for the past twenty years, most recently as a greeter. Recently, he moved to be closer to us, and with that he transferred stores.

At his previous store, he was allowed to use a chair provided by Wal-mart while working as a greeter. At his new store, he has been told by the store manager that "no one here sits, it's district policy." So now, he is standing 8 hours a day for closing shifts.

I have tried telling him that he is entitled to accommodation, but he has said that he knows Wal-mart will somehow skirt around it, and that he'll be fired.

I am walking a fine line here; I want to respect his autonomy but I also do not want my dad put into an earlier grave than he'd otherwise make it to. I'm unsure if I'm being overdramatic about this.

What can I do to help?

EDIT for added details:

  • He has directly requested accommodation. When he did, his manager repeated the "no sitting" district policy
  • He has a doctor's note already in Walmart's system from his previous accommodation request. After asking again, he has been told that he needs a new one. He's working on getting this done now, but says it'll take two weeks for them to process it, at least. He expects it to take longer.

I genuinely am fighting myself from calling the store myself and complaining, but I figure that'd get him fired than him asking for accommodation again.
