Ca- Agreement Breach
Got into a fender bender in a small parking lot. The other party was willing to settle with me and not filing an insurance claim. I made a very reasonable offer which was then countered by an unreasonable one. I told the other party to file an insurance claim. Couple weeks pass, I get contacted by my insurance that a claim has been opened. The very same day, the other party calls me and agrees that we should just settle for the amount I originally offered and cancel the insurance claim. I agreed. The other party wanted cash (no other method of payment) first before canceling the insurance claim. I agreed but only if she signed a release of liability and agreement form. We setup a date and a rough time for us to meet at a public location. They go dark on me the day of. No contact and no answers since via phone and text messages. It’s been long enough to where I believe they are going through the insurance claim. Is there any legal action I can take against the other party for breach of verbal contact? Or any other legal advice? I also have text messages which paints a clear picture of our agreement.
