My Fiancée Is Freaking Out About Her Old Closed Cases Being Reopened By Police Randomly.
Location: California. So my fiancée struggles with mental health, and a few years ago she was having what she believes to be OCD-driven anxieties about things she couldn't remember if she did or didn't do.
She once attempted to turn herself in for a hit and run which she didn't do, she just felt a bump on the road at night and drove around the area repeatedly until going to the station. They opened a case but later closed it saying there was nothing left to do. And secondly, she confessed to dating someone briefly who told her he was older than her, but years later she felt like she had to confess to that too because she never remembered proof like ID, and she was scared she was with someone not of age. Basically the mental process was, "I am in doubt. Therefore it must be true." Again, her case was dismissed.
I tried telling her that it was over. But she believes at some point in the future, the case can be randomly reopened. She believes since she isn't on good terms with that ex, the police will reach out and assume she was guilty of something else. She said, "They might assume from that second confession that I also committed S.A. instead of statutory." She said the statute of limitations for the statutory thing has passed, but is scared another case will open.
I honestly don't know what to tell her. My question is, if the statute of limitations for a confession to one crime has passed, can the police legally go back and make assumptions leading to a case involving a similar crime? Could they legally reach out to the other person (her ex) based on a dismissed case that is beyond the window it can be charged? She thinks they will manipulate him into complying and making up evidence or something, like pushing the date of when they dated further back before he was 18.
