Break Calipers Installed Incorrectly By A Dealership Caused Major Damage - What Are My Options For Legal Action?
Location: DFW Texas
I bought a used Jeep summer of this year from a franchise dealership (not Chrysler), a place that would have a certified pre-owned guarantee inspection before selling. The Car Fax report shows that this dealership checked the breaks, replaced the tires, break pads, break rotors, etc. So far, its has been driving great up until this past weekend...
I was driving back from a road trip, hours away from home, when the front passenger wheel "exploded," and jerked me off the highway and into an empty field. Not sure if this is relevant, but if this had happened a minute later, I would have crashed into a concrete and metal barer over a canal... Luckily no one was injured and no other cars were involved, so it did not cross my mind to make a police report.
I contacted my insurance company and had to pay out of pocket to tow it to the nearest Chrysler dealership. The mechanics at the Chrysler dealership found that the break caliper was not installed properly... all the bolts are missing and the caliper jammed itself into the rim and shredded the inside of the wheel causing the rim to crack and sever the break line. The tire had no punctures or tears. The repair cost would be between $3-4K. I got pictures from the mechanic.
I have full coverage insurance and I did not buy any warranties from the franchise dealership. Optimistically, I would like the franchise dealership to pay for the bill but do I have a case to take legal action? My life was at risk by there mistake, and I have pictures and the report from the Chrysler dealership. Any advise would be much appreciated.
