Insurance Company Lost All My Medical Records To Hackers Including My Therapy Notes. I Received A Card To Claim My Share Of The Settlement Which Is $100. I Feel Like The Nature Of The Stolen Data Deserves Way More.

Location: California

Context: I'm partly disabled and have completed years of therapy for mental illness. Those records are now in the hands of hackers that breached my insurance company and stole the personal information and medical records for millions.

Apparent the breach happened a few years ago and they said they sent out notices, but I don't recall ever getting one. I know they sent them based on threads with people discussing it.

I think the offer of $100 for such sensitive information is disgusting. The data contained could be used to mentally cripple me and I'm going to be worried about it being used or made public for the rest of my life.

I thought maybe I could sue them myself but it's past the statute of limitations I think. I read that it's a certain amount of time from the date you were notified about the breach. Are they required to keep delivery receipts for those old notices? Can I somehow prove I never received it and restart the clock so I can sue?
