Can Deceased Landlord’s Brothers Claim Property Rights Years After Death?
Location: NJ
I have lived in an apartment since 2021. My landlord passed away in spring of 2023 and since then, his wife has legally taken over all of his properties and been the landlady. She is awesome and we get along great.
Suddenly, about 3 days ago I got a voicemail from my deceased landlord’s brother asking very vaguely “how things are going” with my landlady. I did not answer because I was at work, but I let my landlady know he called.
Today when reviewing some camera alerts from my security system, I saw dead landlord’s other brother walking around my yard and knocking on the door. I sent the footage to my landlady. She informed me that they are going around to all of her properties and asking tenants about their rent amounts, as well as entering the premises and taking photos. She is in contact with her attorney about this but since it is a holiday weekend, she isn’t getting very far yet.
My question is, do they have any legal standing as far as taking the properties back somehow? Considering it has been almost 3 years since my landlord passed and his wife is doing a fantastic job in his place? I don’t know specifics but I assume the estate has long been settled. My landlord passed from a terminal illness that he knew of for years, so he definitely had time to sort his will out.
I’m just really worried that somehow these guys will take over my building and either jack the rent up like crazy or sell, leaving me with nowhere to go.
