Location: Magnolia, Texas

I’m facing a difficult situation as a new landlord dealing with a couple on a property I inherited in Magnolia, Texas. The property is 0.75 acres with an RV and two fifth wheels. My father allowed a couple to move in about three years ago to help them when they were about to become homeless, but they’ve since taken advantage of his kindness.

Here's a summary of the situation:

  • My father passed away last year without a will, and while I have power of attorney, the property isn’t officially in my name yet. My two sisters, who have had no communication with my father, have agreed to let me manage the property. However, I haven’t been able to afford the probate process to finalize ownership.

  • The couple has lived there rent-free for almost three years. They were actually present when my father passed away, and I received a text from the husband saying, "Pat Dizzle is dead." While this might not directly impact the situation, it certainly reflects the kind of people they are.

  • My father asked them to find a new place to live several times (around 15 attempts), offering them time to save money and even offering to drive them to look for new housing.

  • A few weeks ago, I put a notice on their door giving them three days to vacate. Instead of leaving, they sent me messages claiming my notice didn’t comply with Texas eviction laws, demonstrating they are well-versed in the legalities of their situation.

  • Additionally, I have screenshots of inappropriate messages from the husband trying to get me to "hang out," which made me feel very uncomfortable.

  • They also bring in tons of junk and items onto the property that they claim are not stolen, but I suspect some of it might be.

I’m currently having bad financial issues and honestly haven't been able to afford to file the eviction. Has anyone dealt with a similar situation, or can you provide guidance on the best steps to take?

Sidenote: They own the fifth wheel and are parked and hooked up on my property. The original agreement was that they were going to pay me $400 per month. They never once have paid me the full $400. $50 here and there but never close to $400. The last few months they have completely stopped paying. And are being extremely rude and have blocked me on social media and blocked my phone number.
