Would This Be Something To File In Small Claims Court And Find A Civil Litigation Attorney For? Location: I’m In California

Location: I’m in California. I have a situation from when I was married. 2016 taxes we filed joint but was a huge tax debt that year from my ex husband starting his own business I had no part of and during our 2017-2018 separation/divorce process when separating our debts he agreed to take the debt. He set up a payment plan with IRS and made some payments. Fast forward to the IRS offsetting my 2022 tax refund to this it was a long messy process applying for innocent spouse relief (denied) then my 2023 tax refund offset as well. After calling almost every IRS department I finally reached a collections manager and found out it was because he stopped paying and the debt was in their collections so of course they can just take it from either one of us. Since I am a W2 employee that files my taxes it’s available for them to take. After calling several different attorneys I was directed back to family law court. I did that and took him back to family law court a couple months ago and the judge sided with me it was an omitted debt in the divorce but in California law debts are community property and 50/50. Ok, I get that. I went directly back to IRS taxpayer assistance and they provided me the transcript showing the debt along with penalties/interest, his payments and my offsets. They have taken more than 50% of this debt from me compared to what he paid. Also, since there is a 5,000$ balance of penalties and interest they told me we do not qualify for them to remove, I just got another statement from them they offset my 2024 tax refund toward it. In total they have taken over 13,000$ from me while he has paid around $9,000 toward this. With the court judgement order and the transcripts from IRs, is this enough for me to take him to small claims court to order him to repay me the difference? Is this worth obtaining a civil litigation attorney over or something self help at the courthouse would be more suitable for? It’s more to me on principle that he feels he is above his obligations and doing this on purpose to spite me. He is also avoiding his child support obligation but that is an entire other issue being dealt with already. I have gotten so much misguided information from so many directions over this it’s driving me crazy.
