Wisconsin Former Guest Threatening To Break In Using Copied Key After 7-day Removal Notice Police Already Involved

Location: Wisconsin. My partner and I allowed her 20 year-old brother to stay with us temporarily. He was never added to the lease, never received mail here, and paid us a set monthly amount directly for a few months. Two months before we told him to leave, he stopped paying entirely.

Due to escalating drug use, theft (including medications), property damage, and safety concerns, we revoked his permission to stay. His last night sleeping here was October 27. He returned his key, but later admitted over text that he made a copy and threatened to enter whenever he wants.

We gave him a written 7-day deadline over text to remove his belongings. We also gave him an extra day beyond that. He came once after the deadline, removed only some items, and refused to take everything even after being told anything left would be considered abandoned.

Police were called due to his threats. Officers told us he is not allowed back inside and that if he attempts to return we are to call immediately. The next day, property management posted official “No Trespassing” notices citing Wis. Stat. §943.14.

He still claims he can come back, says he has video “proof” of staying here, and continues to threaten entry with his copied key. We are pursuing a restraining order.

My questions 1. Does someone in Wisconsin have tenant rights just because they paid rent informally in the past but were never on the lease, never got mail, and stopped paying two months before removal? 2. After the 7-day removal notice + police involvement, is remaining property legally abandoned under Wisconsin law? 3. If he files a civil suit or small claims to recover remaining items, what are his odds and what would that cost him to file? 4. Are we legally allowed to deny any further access without a court order given the trespass warning and police instructions?
