Total Wines Delivered The Wrong Bottle — Then Demanded Me To Return It Myself

I ordered a bottle of red wine for delivery from Total Wine. Instead, they delivered a completely different bottle — a whiskey I don’t even drink. It happened to be a bit more expensive (about $30 more), but that’s not the point.

When I called, they weren’t apologetic at all. The rep literally said, “Well, you got yourself a more expensive bottle,” like that should make it okay. Their main concern seemed to be that they might’ve lost money — not that I didn’t get what I actually ordered.

They also told me they can’t re-deliver the wine I originally paid for. Instead, if I want it, I have to bring the whiskey back to the store myself — a 30-minute drive — which defeats the whole point of ordering delivery.

To make it worse, they said I shouldn’t place another order because I’d “have the extra bottle” with me, like I’m trying to scam them or something.

Am I being unreasonable here? Has anyone else had to deal with something like this? And legally speaking (in California Location: SFO), am I actually obligated to return the wrong item they delivered?

While I understand that Total wine may not have a return mechanism. I’m not looking for a refund, and I also don’t want to spend my time driving back to the store to fix a mistake that wasn’t mine. If Total Wine or their partners can’t pick up the incorrect item, fine — I can accept that. But they shouldn’t be pressuring me to return it as if I owe them something.

This isn’t about the $30 difference. My time and effort are worth more than the bottle. If they can’t resolve it gracefully, at least they should take accountability without pushing the inconvenience back onto the customer. Especially when I’m not legally obligated to return the bottle
