When I bought my house two years ago, it came with a 500-gallon underground propane tank. Turns out it’s leased from Thompson Gas. I’ve since switched everything over to electric, so I don’t really need propane anymore.
Now the fun part:
- The tank still has about 250 gallons of propane in it.
- Thompson says it’ll cost $1,500 for me to have their tank removed.
- They charge $150/year for the tank lease.
- I’ve never signed any contract or lease agreement with them.
- They also won’t give me credit or payment for the leftover propane.
I told them I don’t want to renew or continue the lease, and they basically said, “Okay, but you still have to pay us to dig up our tank.”
At this point, I’m tempted to just stop paying the lease fee and see what happens. But I don’t want to shoot myself in the foot if that’s going to turn into a lien or legal headache down the road.
My questions:
- Can they legally enforce a “lease” I never signed?
- What real consequences could I face if I just stop paying?
- Who’s actually responsible for removing the tank if it’s their property?
Feels a bit like being held hostage by a buried metal cylinder. Any legal insight (or war stories from people who’ve dealt with Thompson Gas) would be much appreciated.
