Tenant Won't Remove Their Property From My House
Location: Missouri, USA
I cohabitated with my (now-ex) fiancee in a house I own, until I caught her cheating a couple of months ago. The blow-up came just as I had obligations that would take me out of town, and so despite the circumstances, I let her and her kids stay in the house until they found a new place to live since I wasn't going to be there anyway, and I love her three kids like my own, and I didn't want them to suffer for their mom's infidelity.
Anyhow, what I assumed would be a couple of weeks turned into a couple of months without any apparent effort on her part to move, and so I gave her, via certified mail, a formal 30 day Notice to Vacate as required in our state for "informal leases."
Her 30 day mark was 11/21; she said she found a place and would be out by 11/29 (with everything moved when everybody was off from work and school this week), and so I held off on filing for a formal eviction proceeding. They have apparently been living at the new place for a few days now, but when I visited the place today... all her crap is still there, large and small, not packed or otherwise ready to move. To top it off, the kids and another "labor resource" are out of town this week visiting other relatives.
I addressed it with her and told her she needed to be gone as we had discussed (I need to put the house on the market, and she is so slovenly that there is NO point in showing it until she's long gone), and her response is that "(I) needed to be patient, and it'll probably take a couple more weeks since her labor is out of town."
I have absolutely no desire to extend any further accommodation to her. What is the next step to get her stuff out of my house? I had the filing for eviction printed and ready to go, and would drop it off tomorrow with the court clerk's office, but... she's not technically staying there anymore. Do I still proceed with eviction even though she's not there, or do I approach it exclusively from a "get your crap out and don't come back" position? If the latter, what is the legal strategy?
