Surprise $1,000 Bill For Extra Allergy Tests I Never Okayed—anything I Can Do?

Hi all,

I’m in New York City and just got slammed with a bill for $1,080 from my allergist. Here’s what happened:

  • I scheduled a initial visit for seasonal allergies.
  • The doctor did a standard skin-prick test; it showed I’m allergic to oak.
  • Without any real discussion, he immediately moved on to a second round of testing 20 separate intradermal injections “to be thorough.” I wasn’t told what they were, how much they’d cost, or that they were optional. I didn’t object at the time because I assumed it was part of the visit and honestly didn’t know what was happening until after the fact.
  • My insurance EOB came back and these extra injections weren’t fully covered, leaving me on the hook for the $1,000+ balance.

Is there anything I can do dispute the charges for lack of informed consent, appeal to insurance, negotiate with the provider, etc. to get this reduced? Any specific NY laws (or federal surprise-billing rules) that might help here?
