School Transportation Van Put My Daughter In Danger

Location: Pittsburgh My daughter has a rare genetic condition called Congenital Central Hypoventilation Syndrome. She is Trach/vented and can not sleep without her ventilator. She will die if she falls asleep too long without her vent. She is in 1st grade. But when she started kindergarten we met with the school and went over her medical condition. We made it very clear that she can not sleep without her ventilator. If she is for some reason too tired at school then she will be sent home to be safe. Her pulmonologist sent the school all of her information about her condition. The school set up an IEP for her. She takes a van home in the afternoon because she’s usually more tired in the afternoon and the van gets her home quicker and there is an aide to help make sure she doesn’t sleep. The other day the driver was dropping her off and told us she thinks she was sleeping and once my daughter came inside the house she confirmed that she was sleeping and was upset. I contacted the school and the director of transportation. They have contacted me and are taking it seriously, as they should. But I feel as if the school is just trying to cover themselves. The principal doesn’t seem to have a lot of remorse. The owner of the transportation company called me multiple times in one day to go over what happened. He left a voicemail saying the aide was a sub for the day but she was an instructor for the state? I’m not sure what that meant but he said there was no excuse for the failure of the training within their company. He seemed remorseful but again, I think more so to cover himself. My daughter is okay but it could’ve been worse. And now I feel like I can’t trust the school with her safety. I feel extremely uneasy. My husband is considering legal action but we aren’t sure if we have a case. Are there any lawyers who could give me advice?
