Remote Worker Located In Vt - Company Located Fl - Wondering Which States Employment Laws Apply To Me

Hi everyone,

I’ve worked remotely for a company based in Florida (US) for about five years while living full-time in Vermont (US) that entire time. I’m a full-time, salaried employee.

Recently, my employer has been late on regular bi-weekly payroll payments, now two pay periods in a row. The stated reason has been “delays collecting payment from clients.” • The first late paycheck was eventually paid in full, but one business week late (essentially right before the next pay period). • They’ve already notified us that next week’s pay will also be delayed.

From what I can tell, Vermont has fairly strict payroll laws regarding timely payment of wages, and it seems like this might be illegal under VT law. However, Florida’s laws appear to be much weaker or less specific in this area.

I’m having a hard time figuring out which state’s employment laws apply to me: • The company is incorporated and operates out of Florida. • I’ve lived and worked exclusively in Vermont during my entire employment.

Obviously, I’ve started looking for new employment given the situation. But in the meantime, I’m wondering:

Do I have any legal grounds under Vermont law (or otherwise) to insist that payroll must be met on schedule?

This ongoing pattern of delayed paychecks is creating real financial strain. At this point, I just want to know whether I have any leverage or recourse to demand timely payment, regardless of their client payment issues.

For full transparency: the company seems financially mismanaged, and it appears the owners are maintaining their personal lifestyle at the expense of payroll stability.
