Public Defender Lied About Lab Results Convincing Me To Plead Guilty In 2021, Is There Any Way To Retract?
Location: Arizona
Driving from Californnia to Arizona In 2021 I was pulled over and administered, 15 separate field sobriety tests, car was searched, I take perscription adderall, nothing else in my system no alcholhol. After blood & urine samples they drove me to a hotel told me I had a court date, and my vehicle was towed. They also took my entire perscription of Adderall which I filled days prior.
I have court over zoom I'm assigned a Public Defender, and I request lab results pushing the case back until they are recieved.
Months later my Public Defender emails me a plea deal, with no explanation after calling him, he tells me my lab results show positive for meth. I explain the adderall perscription, he claims their tests could tell the differences, and later he sends me a modified jped of a lab result with my case info saying Amphetamines Yes Methamphetamines Yes.
I don't take meth.
Threats of further prosecution convinced me to sign a plea to prevent criminal charges because they consider the Adderall I had on hand (Which I had a valid perscription for and provided the arresting officer) narcotics and I would be prosecuted for a felony. I pleaded guilty to a misdemeanor DWI (Impaired to the slightest degree) (Perscription medication) afterwards recieved fines, fees, and requirements I did not agree to (igntion interlock, SR-22, Alchohol Courses)
Years later a curious friend looked into the specifics, the lab results I was sent from PD listed two tests that wouldn't differentiate between Adderall and Meth.
I contacted the lab to to see if I could request a full copy of the results to which they replied "We can only report our findings to the submitting agency, also the image you've sent is not a certified copy of our lab results." They could not elaborate.
Is there any way to retract or undo this guilty plea? This took place in Quartzite Arizona.
Edit: Thank you for taking the time to read and respond, I wasn't sure how shitty the entire situation was until I started explaining the details to my friend who's a legal aid.
There really were 15 field sobriety tests (6 were administered at the station). I started keeping count after the 3rd. They drove me back to their station after 8-9 attempts, he was convinced I was on something. after 6 more succcesfful field sobriety tests the last straw came when the original officer went to demnstrate walking in a straight line again, he lost balance and I started laughing hysterically, he jumped up and went "Demonstrating manic behavior and hysterics, unable to complete the test administered date and time" another officer came up behind me handcuffed me and read me my miranda rights. They took my fingerprints, handed me paperwork, and drove me to a nearby hotel and told me I can pick up my car from the tow yard tomorrow.
My public defender explained to me that I had to take this deal to avoid a more severe criminal & drug charges. But the documents I was given after signing shows "The state agrees the following charges are dismissed or if not yet filed will not be brought against the defendant" And it's just a bunch of blank spaces. That specific paper, I didn't sign, the Public defender signed for me, I docusigned something else entirely, and after I pleaded Guilty to the judge I was sent extra papers with the public defenders initials all over and my docusigned name.
I will be checking out those sites and paying for legal counsel, hopefully they can point me towards the right lawyer because it sounds like there is a case.
