Neighbor's Dog Bit The Guy Mowing My Yard Through A Chain Link Fence.
Neighbor has 2 pit bulls who run aggressively into the janky chain link fence on our shared property line. Their side of the fence is riddled with boards that make it very obvious their dogs dig and break out. I've owned my home for 6 months and rarely go into my backyard unless the dogs are inside their house because I am fearful of them getting through and injuring me..
The lawn guy (who also lives in the neighborhood and has been mowing this yard for years before purchased it) was mowing down the fence line, when one of the dogs ran across their yard at a high rate of speed, hit the fence, and somehow got their mouth through the chain link and onto his arm. It ripped his shirt, knocked him off his feet and left deep puncture wounds. He had to kick the dog through the fence to get it to release. I was not a witness and do not have camera footage, but a second man working in the yard was witness.
I heard him screaming, went to check on him and applied a compress to his wound, and called 911. He was transported by ambulance, police took reports, the neighbor's dog was quarantined, and I made a 311 report as well.
Is there anything else I should do to protect myself in this situation? Do I make my homeowners policy aware? Is there any liability on my part for this happening?
I have plans to build a fence. Would I have any recourse to get this neighbor to pay for part of it? I don't get the feeling they would do it willingly. They did not admit to their dog biting the man when questioned by police.
Location: Dallas, Texas.
