Neighbor Forcing Me To Pay $6000 To Remove A Dead Tree That Appears To Be Right On The Property Line. Pay Or Seek Legal Input?
Briefly, I have a very unpleasant neighbor that reported a dead tree to our city that appears to be right on the property line. There is an old chainlink fence from many years ago that has been pushed around the tree placing it on our side of the fence; however, from the corners of the property it appears to be right in the middle, if that makes sense.
After making a good faith effort to resolve this with our neighbor (she will not speak with me), the city ultimately agreed to send her a letter of responsibility as well. Nevertheless, apparently she knows someone related to the mayor, so now the city sent me a new letter that I am responsible and not her.
To further complicate things, the tree is in a difficult area to access right next to her driveway. Companies have quoted me a cost of at least $6000 if they cannot use the driveway.
Do I have any recourse? It seems like a survey might be necessary to prove it is on the line but this is also quite expensive. I am also worried that if I were to go that route, what would happen if it is volumetrically slightly more on my side?
Very frustrated that the burden of proof has been placed onto me based on an arbitrary crooked fence.
