My Roommate Is Forcing Me To Move But Refuses To Refinance A Shared Loan For The House.

six years ago, i (29f) purchased a house with my now ex (30m) who we will call john. john and i have been split up for over two years, but since the house is in both of our names we have lived together as roommates. we are both dating other people now. while the house paperwork is in both of our names, the mortgage loan is in only his name. due to this, we decided when the time came i would move out and he could keep the house.

september of last year the ac unit went out, and since we both thought we would still be roommates for a while, we got a personal loan in both of our names to replace the unit. we did not have enough saved between the two of us to replace it, so a loan was necessary. we got the loan at a bank that i work for, which got us a slightly lower percentage rate. despite the fact that he makes much more than i do, i pay more on the loan than he does. i pay about 75% of the monthly payment and he pays 25%.

the issue here is we have not been getting along recently. there have been several times where he has threatened to kick me out of the house. the thing is, i have plans to move in with my current boyfriend. there are some things at the house he wanted to finish taking care of before i moved in. he has been replacing the windows at the house and all that is left is in the master bedroom, and then the house doesn’t have central air. we use window units during the summer. he wanted to install a unit and finish the window replacement before i moved in. we have discussed this and had a plan in place. however, john is insisting i need to be out of the house by january 1st. he says he does not care if i end up homeless, he wants me gone.

i told him my only stipulation is he needs to refinance the personal loan and put it into his name only, and then i will move. i do not want to have a loan tied to my name for a house i will not be living in and i dont want to be obligated to pay for it, either. he keeps refusing and telling me to remove my name from the loan. i’m not sure if that is possible at other banks, but at the one i work at that is not a possibility. if two people are on a loan and one of them is going to be taking sole responsibility for it, that individual needs to request the refinance to have it put in their name only. i have tried explaining this to john and he accuses me of lying (it’s almost like i work in this field and have to explain this to people every day)

is there anything i can do, legally, to remove my name from the loan if he refuses to refinance and remove my name? i have spoken with the lending dept at the bank and they said i could look into legal options, but there isn’t any way to just remove my name from it. i’m at a loss here. i just want to be done with this house and john for good once i move and i feel like he is holding this above my head.

*also; i know it will a different issue entirely if he goes to sell the house with my name being on it. that isn’t something that’ll be happening anytime soon, so i’m not concerned with it at the moment. my concern right now is getting off of this personal loan.
