Marriage Annulment

Card image cap

Location: Washington state, and I’ve been married about 5 months. They do not do “annulments” here, but rather “invalidation of marriage”. I’m curious to see if my situation would be sufficient for an invalidation based on “fraud”. I want to note that we still live together—however, I am disabled and entirely financially dependent on my husband, so it’s currently my only option until I figure something else out. I’m on SSDI but that’s my only personal income. As for the fraud, I feel intentionally misled on an important issue. I wanted to have a child at some point, and prior to the marriage, I was told by my husband he wanted to have a child as well. I got married under the pretense that we would have a family someday. My husband recently told me that he actually has never wanted to have a child, and married me hoping I’d change my mind. His reasons are that my condition is genetic and he doesn’t want to raise a potentially medically complex child. He also said he worries about my ability to take care of a child due to my condition, and because he’s the provider, I would be the sole caretaker of our child. These conversations have all been face to face, but we both have people in our lives that have witnessed us speaking about starting a family before we were married. My husband has also had conversations with friends prior to our marriage about never wanting to have children. I wouldn’t have married my husband if I knew the option of having children was completely off the table, as he is not willing to change his mind. We’re both not willing to budge and agree that makes our marriage irreconcilable. That being said, I know getting a marriage invalidated is difficult, and I’m worried about proving our claims. Yes, divorce is an option, but with such a short marriage, it would be ideal to have it invalidated. Do you think we have a case for invalidation? Thank you in advance!
