Legal Separation - Spouse With Disability
Location: California (US)
Hi all,
I’m looking for guidance on how a husband with ADHD and depression can document efforts to manage household responsibilities (e.g. cleanliness) during a legal separation case. The husband has a history of having difficulty keeping the house clean and has had an issue with smoking in the backyard that has caused a fire. Because of this, the wife is wanting to file for legal separation due to safety concerns and issues with cleanliness. It is dirty to the point that the pathway is blocked from dirty laundry. The goal is for the spouse with ADHD/depression to keep the marital home.
Specifically: • What documentation best shows reasonable effort and accommodation for ADHD/depression related challenges?
• If the spouse with ADHD/Depression seeks therapy services to address the issue of helping keep the house clean and safe, does seeking the services from a family member who is a therapist affect the credibility? Would it help the credibility if the service is paid for? Or are structured session notes, goals, and progress tracking sufficient?
• Are there any tips for tracking communication, chores, and safety/financial concerns in a way courts or mediators view favorably?
Thank you in advance.
