Issuing A Subpoena

Location: In the Superior Court of Washington State, in and for the County of Pierce

My former employer is sueing me for 'refusing to leave' the property I worked and lived on via RCW 7.28.

I got a new phone in April 2025. A lot of evidence I have for hours worked and nature of the relationship, among other things, were lost with my old phone in August, when my old phone was disposed of along with a lot of my other personal property. My former employer admitted to this or at least admitted to the intent of it:

"I'm assuming you've gone through all your tools because anything out here now is garbage and I'm throwing it away today" -text message from former employer

My old cell phone was among the things he had declared was: "now garbage"

His phone should contain text messages between him and I that would have been on my old phone, and between 4 or 5 different phone numbers that I have had over the course of my employment and occupancy. So even if he deleted my last number, he might not have got them all. What actions can I take to make him produce them with the least amount of risk of them being deleted? He has 3 different numbers simultaneously, I have had 5 total and each of his 3 numbers probably have texts exchanged between each of my 4 or 5 previous numbers
