Hoa Maintenance Guy Took Photos Inside My Condo And Now They're Accusing Me Of An "unapproved Modification". What Are My Rights?
Location: Colorado
So something weird happnd at my condo building and I'm kinda freaking out cuz I dont know if I messed up legally or not. Few weeks ago our HOA hired a new maintenance guy. Super friendly dude, mid 30s maybe, always says hi. Last Friday he knocked on my door saying he needed to check the water heater in my unit cuz they had a "pressure issue" on the floor.
I let him in (yeah I know, maybe dumb). He looked at the heater for like 10 seconds and then asked if he could take a photo of the serial tag. I didnt think much and said sure. Then he took a pic not just of the tag but like the whole closet and even part of the hallway behind me. After that he said all good and left.
Next day I get an email from HOA asking me to "provide documentation" for an "unapproved modification" to the heater closet. I havent modifed anything since I moved in. The email also said their maintenance staff "noticed possible code compliance issues" during a unit check. I asked what they meant but got no response yet.
Now I'm kinda paranoid. Did the maintenance guy even have the legal right to enter my unit with such a vague reason. And can HOA actually use pics taken inside my home to claim violations without notifying me first. My lease says they can enter for emergency or scheduled maintenance but nothing about surprise checks for random issues.
Do I have any rights here or am I basically stuck waiting for them to claim I broke something I didnt. What should I do next step so I dont get fined for something I didnt even do.
Sorry for typos my hands are still shaking lol.
