Fired For Refusing To Serve Alcohol After Legal Closing Time (wa). Do I Have A Wrongful Termination Case?

Card image cap

I was working as a bartender in Location: Washington. Our bar is licensed to close at 11:00 PM, even though other bars in the same hotel stay open until 2 AM.

At 11:01 PM, a customer came in and demanded alcohol. I told him we were closed but that he could go downstairs where the other bars were still open. He got loud with me, said it was “bullshit,” and kept pushing. I told him again we were closed and walked to the front desk/security because he was becoming hostile and I didn’t feel safe.

He saw me talking to security and decided to file a complaint saying I was “rude.”

The next day, my manager called me saying a customer complaint had been filed. I explained exactly what happened and asked her to check with the security guard and MOD who were both present. She said she would investigate.

Two days later, after she removed my shifts and then fired me over the phone for “being rude to a customer.”

I was following Washington liquor laws and our posted closing times. I’m concerned this was retaliation for refusing to illegally serve after hours.

Do I have a wrongful termination case in Washington, especially under the public policy exception for refusing to commit an unlawful act? What should my next steps be?
