Employer Says We Can Adjust Timecards Anymore

Card image cap

Location: California

I work on an island so we rely on a ferry system to get us to work. With the previous owners, we clocked in when the boat left the mainland, slightly earlier if we help load stuff into the boat. And we would clock out when the boat departed the island, regardless of if we were working or not, simply because we were stuck there until the boat left. We would use paper timecards and turn them in at the end of the pay period. With the new owners, we now have a tablet we clock into.

We have location 1, the store, and location 2, the rentals. The store has the tablet. The manager closes up the store and leaves for the day, but the rental shop stays open. The manager is the only one allowed to have a key for the store. So the guys running the rentals can't clock out.

We recently got in trouble for adjusting timecards because "they've been sued over it."

The new plan is to take the tablet to the rentals after the store closes so they can clock out. But this means that no one can clock in at the usual time when the boat leaves the mainland. The ride takes about 15 minutes. Can't they be sued over this?

There has never been a discussion of "no we won't pay them for boat travel." Or if it has, my manager hasn't passed that information onto us.
