Dealer Sold Me A Car That They Never Owned.

Hi All.

A long, ugly story. I was in the market for a used Nissan Ayria. I received a text message on a Friday night from my salesman that he had found the perfect car. Low mileage, great price. I was at the dealership Saturday morning when they opened. After 20 minutes, he told me the car was sold, but he had a different car, which was a little more expensive. Fine. I did all the paperwork and left with a loaner. He says it would take a few days to get the car. Wouldn't return my calls. I went to the dealership on Thursday and was told they changed transport companies, and it could take a week. That night I received a call that when the transport company went to pick up the car, it was damaged. I said, Let's cancel the whole deal. I went in the next morning and picked up my trade-in. A few days later, I bought a CarFax, and the car had been sold to a dealer in Florida. I spoke with the Florida dealer and they said the car was fine and delivered it to their customer the following day. It took 15 days to get the loan flat canceled. I lost $500 on my CarMax offer in the interim. Wells Fargo said that if the dealer didn't return the funds, I would be on the hook for the loan without ever receiving the car. Do you think I should pursue any litigation against the dealer or just accept the $500 CarMax loss?
