Customer Threatens To Sue Me For Not Doing Free Labor While Owing Me Money

Card image cap

I'm doing landscaping as an independent contractor and I have this one customer who asked me to prepare beds for mulch installation and put mulch. I let him know that I charge 40$/hour and started to work. It takes several days because it is a huge property, so as I was going I would report to him over text messages how many hours I worked and how much it is and he would pay. Recently he started complaining that he had a quote for 1200$ from a landscaping company before for the same job and we are already over that budget (but most of the expenses are materials).

I thought that okay maybe it is getting a bit expensive and went to Home Depot, bought more materials and installed them without asking to pay for work.

I sent him 2 receipts from HD asking to pay for materials that I bought for his house and already installed (landscaping fabric, stakes etc). He replied "50.71plus 30.15 Equal 81 dollars. I am going to save it. Thanks" and never sent me this money.

Yesterday he asked me to finish the job, but I refused to do so before he pays me for materials. He answered that we are already over the budget, so I said I'm not coming. He got angry and replied "I'm suing you!".

What are my prospects in this case? We didn't have a contract or anything, I didn't give him any quote. I think it is him who owes me 81$ for materials I bought for him. I never promised to finish anything.
