Credit Card Debt,wife Died, House In Both Names. No Joint Accounts, New York.

I like the title states we are in the state of New York and the wife passed away leaving about $60,000 in credit card debt with her own bank account. The husband did not have a bank account of his own at all or any credit cards in his name he may have been an authorized user on her cards. There is a home that’s fully paid off. There is NO WILL.

The husband is not looking to sell the house and just wants to live there and continue to pay the property taxes, but he’s deeply concerned that some sort of judgment or creditor will try to seize the home or put a lien on it or force the sale of it.

He’s going to let the bank know tomorrow that his wife passed away. Does this make sense? Again he had no bank account of his own and would just allow his Social Security to be deposited in his wife’s account. He was able to see the account balance and it’s completely negative by thousands of dollars I guess there’s some sort of overdraft protection.
