Child Support Arrears And Hiding Income / Oregon

Card image cap

I am navigating a complex situation with my co-parent, who has ceased making child support and spousal support payments. They claim their Class C felony conviction (related to abusing our daughter during infancy) prevents them from securing employment. They previously received Oregon unemployment benefits, which have now been exhausted. During a conversation, they inadvertently mentioned working under the table but quickly retracted the statement. We are currently in court to modify our parenting plan, and I have filed a contempt motion due to their $14,000 in child support arrears. Their attorney argues that, absent proof of their employment, a judge is likely to rule in their favor, potentially retroactively reducing the arrears. They further contend that, given my stable income, I may be ordered to pay child support to them, despite my having custody of our child 90% of the time. How is this outcome plausible under such circumstances? What is the most strategic course of action? I am represented by counsel, but I am overwhelmed by mounting legal fees and frustrated by their apparent lack of proactive advocacy. As a single parent shouldering all financial responsibilities, I am struggling to manage these challenges.m and want to know if anyone else has been in a situation like this and what they did.
