Child (14) Asking Biomom(me) To Redeem Custody From Adoptive Dad (west Virginia/unusual Cps Ending)

Location: West Virginia Hi, I had a cps case in 2013 when my child was two going on three. I’m an addict in long term recovery with 12 years abstinent from all drugs and alcohol. My child has a kidney disorder that required catheters every 4 hours and despite me reaching all goals in my reunification plan, I didn’t have the means to leave work to provide a catheter during the day and there were no daycares on the bus route to provide this service. We ended up with an open adoption, I got my child every other weekend the entire 12 years clean (with the exception some random weekends due to son getting older and preferring friends of me sometimes.). The couple who adopted him was amazing, but adoptive mom died in September of 2021 and his adoptive father has a temper (no physical abuse that I’m aware of). He’s very strict, doesn’t take into consideration my child’s ADHD diagnosis and holds extreme expectations my child fails to meet. There’s been times where my child desperately needed support at school in the form of therapy or medication adjustments and dad just doesn’t bother. It took him a year to listen to me this last time and make a psych appointment. In his aging hes getting increasingly unstable emotionally, threatens to sell items my child bought for himself and loves(fishing poles this time), has taken and thrown away computers and game consoles I’ve purchased, etc. My child is about to be 15 and he’s miserable. He asked me if he could come live with me, mentioning at 14 the child’s wishes will be considered by the court, but this situation is far from ordinary. My court paperwork has a note from the judge that recommends the court take into consideration if ever I petition, because the circumstances were out of my control, but were favorable according to the court. I’m sorry for grammatical errors and inappropriate verbiage. Slightly emotional right now, feeling powerless.
