Arizona - Solar Company Trying To Get 70yr Mom To Sign A Lease Again?

Location: Arizona

My mother in law who turns 70 in Jan of 2026 signed a 25 year Solar lease with a solar company back in February (why she thought this would be a good idea when the payments at $200 a month and her energy bill is usually less than $100 we don't know). We didn't know about it until July when they began installation. At that point, there didn't really seem to be anything we could do as the 10 day no penalty cancelation period had passed.

Going through her emails, she had set up automatic withdrawals for the payments and confirmed the account information was correct. But the payments never started. We believe this puts her in default of the lease which obviously comes with remedies that are quite expensive.

Now, two days ago, the solar company has sent her a new contract, almost exactly the same in terms of terms of agreement, payment, etc but dated for October 9th. The 10 day no penalty cancelation clause is also in this new lease.

My question is: can they have two solar leases for the same property? What would the reasoning be for that? If she signs this second lease is the first invalid? If so, does that mean she could cancel in 10 days with no obligation to the first lease?

I understand that shes had the equipment since July and her non-payment doesnt just disappear as she did utilize the stuff, but why would they want to start all over on a lease that makes it longer than the original term and still want payment for months in the first lease. We are trying to avoid the default clause. Not the owed payments.

Also to add information: my husband and I just moved back into town after we discovered the first lease as we realized it might be time for us to start watching over her. Now we've discovered shes been taking mematine for alzheimers and dementia and we have an appt set to find out when she was diagnosed. If it turns out its been before February, does that help get her out of this Solar contract?

Thanks for any help. This is a $75,000 lease over 25 years. Upon death the lease passes on to the estate and upon sale of the house, the new owners must qualify for the lease credit wise or my MIL is considered in default. I have a copy of both the lease from Feb and now.
