Ai Recorded Doctor's Visit Without Consent

Location: CT

I recently had a doctor's visit for my newborn. The reason for the visit was pretty standard -- baby had a red eye and I was concerned about infection. Following the visit, a recap is posted in my MyChart app where I also have the ability to message the office, check on paperwork, prescriptions, etc.

Anyway, I noticed that the recap of the appointment was very thorough compared to previous visits. It included almost everything we talked about regarding the baby's eye, height/weight, etc. Other questions I asked about breastfeeding and vaccination schedule were not included. Then, at the bottom of the recap appears the following sentence: "The patient gave verbal consent for this note to be written with the assistance of ambient listening."

I had to google what was meant by "ambient listening" and realized that it's essentially an AI recording of our conversation, intended to assist healthcare providers (and others?) with note taking. It seems like it's becoming pretty standard in the industry. However:

1) I did not consent to be recorded, verbal or otherwise, which raises major ethical concerns for me

2) I am ambivalent toward AI in general, and I have nothing against note-taking assistance, but I have serious concerns about my healthcare data potentially being stored in a third party database, particularly sensitive information

3) I have major ethical concerns about the fact that I was not aware of being recorded, as this feels like a potential wiretapping violation

Anyway, I'm not sure what to do from here. I'm considering:

a) contacting the healthcare provider and asking about the recording policy, consent procedure, etc.

b) contacting an attorney

c) contacting the state health department

d) bring a witness to my next appointment and see if it happens again (that way I can definitively prove that I did not provide verbal consent to the recording)
