Telling Someone To Hurt Themselves

I posted the statement below on a parenting thread asking for advice for my brother on how to handle the punishment of his daughter. It was recommended to post here since this could turn criminal. At the time, I didn’t realize this could turn into a criminal charge.

Location: Ohio

I have an 11 year old niece. She is my brothers daughter. My brother has split from her mom about 10 years ago.

The other day he was going through her phone and found out she texted something terrible to another girl in her class. The girls dad committed suicide, I’m not sure how recent. My niece told the other girl, “I can see why your dad killed himself.” And “you should put a pistol in your mouth like your dad”

Of course we were all appalled. My brother called me asking what he should even do. He’s not sure how to handle a punishment for this type of thing. (I will add the girl on the other end of the phone was not innocent either. While it doesn’t make what my niece did okay, I felt it was necessary info to add)

I told him I’m not sure either. But the words she used towards the other girl made me think they should seek some sort of therapy. I’ve tried to research what other parents have done. But the only thing I’ve found is about their child being the one bullied.
