Roommate Took My Vehicle Without Permission And Wrecked It

Hi everyone,

I need some advice regarding a legal situation with my roommate. He took my motorcycle keys without my permission and used the bike, which he ended up crashing, totalling it. He initially admitted fault and agreed to pay for the damages, but has since cut off all contact and is refusing to pay.

When I attempted to speak with him in person, he called the police and accused me of invasion of privacy. The police treated it as a personal matter and suggested I either pursue mediation or sue him for the damages.

I have several pieces of evidence, including:

  • Text messages where he acknowledges the accident and discusses replacing the bike or paying for the damages
  • An Instagram reel he posted after the crash, showing the wrecked bike and his injuries
  • A damage report for the motorcycle
  • The bill of sale and related ownership documents

One complication is that he was listed on my insurance at the time, but only for prior authorized use—not this incident.

I’m planning to sue him for around $8,000, which reflects the material loss. However, I’m concerned because he’s not a U.S. citizen and has expressed plans to leave the country within the next six months.

What’s the best way to move forward with legal action, and is there any way to prevent him from fleeing the country without paying for the damages?
