Noncompete Enforcement Deadline Passed But Company Wants To Enforce
Location: New York, US
(Noncompete is paid so it is legal)
I left my company and recently notified them that I had a job offer from a competitive company. In the noncompete agreement, there’s a clause that states the company will notify me of enforcement within x business days. They kept telling me that they would have updates for me, but that deadline has passed. However, a week and a half after the deadline passing, they emailed me that they want to enforce because my new company is most definitely competitive. She said it’s because she was OOO that she could not email me . I had given them multiple chances to respond, but because there was no notice from them during the enforcement notification period, I have now already started my new job. Do they have legal grounds to sue me at all? Or am I in the clear because they missed their deadline that is clearly stated in the noncompete agreement letter? Please help me ASAP
