Need To Leave My Husband. Unsure Of The Crossing State Line Rule.

Location: CA Planning to relocate to NH.

I have no friends or family here. All of my support network is in New England. We have a mortgage here but other than that, no ties.

I need to leave my marriage. I have a temp job lined up that I am supposed to start in 2 weeks. The plan was to drive east with my 2 kids, stay with family, and work. My husband works remotely and would be joining us in a few weeks.

Things have gotten bad though. I intend to still go east with the kids. He is threatening to quit his job, which I don’t care about anymore since I have one lined up. But he said I’m not allowed to go east with the kids, that he was going to stay here and have me arrested if I leave with them.

Obviously I don’t want to leave them with him in CA, but I don’t want to quit this job before it starts because we need SOME sort of income and if we split up anyway, I will need my career un-torched to get back on my feet.

I need to know the legality of driving cross-country with my children. My husband has not been physically violent with me or the kids (he has damaged property) but he is very, very spiteful and I can see him trying to get me in trouble for trying to leave. However, we are still legally married with nothing in the pipeline yet for separation so there are no custody arrangements. It would just be a mom driving with her kids as planned.

I want to know if I could get arrested and lose my kids for proceeding with leaving our house and driving 3,000 miles to my parents.
