My Wife’s Family Didn’t Tell Her She Was A Beneficiary On Her Grandfather’s Will And Spent 10 Years And A Lot Of Money Trying (unsuccessfully) To Contest The Will And Get Her Removed

Location: Oregon

Ok, so a little background. My wife’s grandparents raised her from the time she was 6. Her grandpa loved her like a daughter, but her grandma resented her and always reminded her that she was not her child.

After her grandpa’s passing, she was told that she could not attend the reading of the will because she was “just a grandchild” (she was 23 at the time) and that she “isn’t in the will anyway”.

Over a decade later she found out that she is, in fact, a named beneficiary in the will, but was never informed. On top of that, they had spent tens of thousands of dollars in legal fees to contest the will and get her removed as a beneficiary (as well as add back in his children that he had left out). They exhausted all their efforts and were unable to get the will changed.

Now her grandma is supposedly holding onto the will (which does not appear to have ever been filed, btw) so that she can use her own will to “right the wrongs” by compensating her excluded children in order to make it “fair”.

She still will not let my wife see the will, but we estimate that my wife’s portion is somewhere in the mid six figures. Her grandpa wanted her to be taken care of when he was gone, and his wishes were ignored.

Is there any legal action that we could/should take?
