My Sister Is In Jail Again In A Year And Need To Take Custody Of Nephew

Location: Texas Last year we had watched my nephew for a year when she was in jail. we asked to about taking custody of him that upset her but with the Military he won’t have any of the benefits like school, healthcare, or possibly childcare. This year she’s back in jail for possibly 2 years or longer if she’s not bailed out. And she’s talking about going to rehab after. Me and my husband are tired of just taking my nephew in when it’s convenient for her. We want to take him in full time with custody. Because what’s the point in giving him a stable life to be thrown back into an unstable life where he can run around like a wildchild with no one to take care of him. What would be the first steps to go about it? She has a history of drug addiction, burglary, having credit cards in others names, having a firearm while being a felon, and assault. I don’t think it would be hard to see who’s fit. She hasn’t had a job in like 10+ years either. But my situation is I’m a stay at home mom with a 9m old I’m pregnant we’re living in a 1 bedroom apartment looking to move into a house. Neither me or my husband have any charges.

Tldr: my sisters is unfit need to see how to get custody of my nephew.
