Landlord Trying To Back Out Of Lease Terms
Location: Missouri
I received two leases,
A preliminary lease stating parking was $95/month per car, and six months free parking for 1 car (value $570) this was signed by my roommate.
A secondary lease stating parking was $0/month per car, this was signed by myself, my roommate and the apartment complex and six months free parking for 1 car (value $570)
After asking them to uphold the $0/mo parking on the lease they said
It was an error and I have 2 options
"Option 1: Correct and Re‑sign the Lease . We update the lease with corrected parking charges, as intended , and you re‑sign that addendum. All existing items remain in place.
Option 2: Honor the Lease As Currently Executed as requested. Please note that if parking is removed:
- The $570 concession tied to parking would no longer apply.
- Garage access would be revoked, as it is only provided to those covering parking access costs.
I responded highlighting the lease terms
-parking charge of $0.00.
-Parking will be revoked if delinquent in paying the required parking fee. I do not believe there is a contractual basis to revoke our parking privileges.
No statement in lease saying they could remove either the parking rights or the concession under these circumstances
Now they are forcing me to go with either option by tonight. HELP!!!
