Hoa Says They Can't Force Condo Neighbors To Be Investigated And Treated For German Roaches, Despite Infestation Building Wide And Bylaws. Atlanta Ga

German roaches have infested our condo building in Atlanta, and our HOA management is refusing to act and force all units to treat. It is within bylaws that "no neighbor shall create an unsanitary, unsightly, or nuisance condition", and we believe we know what neighbor caused this, as he has been seen hoarding in the past with his unit full of trash and garbage everywhere.

He started hoarding last year. A horrible rotting smell came from his unit, I called in a wellness check and Adult Protective Services, his daughter cleaned his unit up for about a month, so he’s not hoarding now, but there is still trash everywhere when the blinds are cracked (solo cups, pizza boxes, opened bags of trash sitting everywhere for weeks). The roaches started when he started doing this, and all of us now infested share the common kitchen wall with him, and it all started in our kitchens which back up to that wall. The neighbors above me are treating with pros, but the neighbors below me are refusing and just using store bought bombs nonstop. I've been using pros for two years and this happened anyway. My guy confirmed i am not the source and they're coming from somewhere inside that wall (well - they were til it got out of control in the whole building).

The HOA says legally they cannot be forced to treat or inspect despite the bylaw. Upstairs called Code Enforcement who came out but didn't do anything except note her own infestation. How do I force the HOA to find the problem and uphold the bylaws? I’m at my wits end and I can’t afford to sell this place and move, there is literally no money to do so (I pay $800 a month). A pest control company I called (different from the one I'm using) confirmed in GA an HOA cannot force a unit to treat. Is this true? What do I do? I've submitted my own complaint to code enforcement in hopes of getting some type of traction. I've spent thousands on this as well between treatment and home prevention (bags, bins, storage unit, etc).
