Guy Attacked Me At Football Game, Let Off Because I Flipped Him Off First - Advice?

Location: Texas A guy and his girlfriend had been harassing me and my fiancée for sitting in our seats and not moving (school tradition is to stand on the risers but my fiancée was six weeks out of a hip replacement and had to sit occasionally). I flipped them off without turning around (we were on the riser in front of them), and he jumped down onto me with enough of a shove for me to lose my balance.
I recently pulled the police report and the cop charged him with assault (offensive contact) but charged me with disorderly contact (offensive action/gesture), and when I met with him he said they “cancelled out” so they’re not pressing charges.
I don’t feel that my gesture meets the standard for “fighting words,” and while I wasn’t seriously injured from the assault, I didn’t know at the time how far it would go and it was very emotionally distressing for me and my partner. Also, the report omits the fact that they were harassing us beforehand (even though we told the cop that and there is apparently body cam footage of us talking to him about it).
Is there any point in fighting this, or should I just let it go?
