Employer Says They Are Deducting Overpayment From Remaining Pay Checks

Location: New Jersey

I have been interning at this company for almost 5 months now, and I receive an email today stating that the company will be deducting overpayment they have made from my remaining pay checks due to their "clerical error."

A mistake was made when they set up my ADP payroll account, which granted me the ability to submit PTO requests. When I started my internship, I didn't believe that I had PTO nor was I promised PTO in my offer letter and/or contract. When I signed into my ADP account early into my tenure, I was delighted to find that I had a balance of PTO hours that I could use and the ability to submit requests. And so that is what I did.

I submitted multiple PTO requests that were all accepted by my direct supervisor. I took the occasional day off for a sick day or a doctor's appointment, thinking "no big deal, I have to use my PTO before my contract ends anyway."

The email I received today says that interns are not entitled to PTO and that I should never have been granted the ability to submit these requests.

Had I known that I didn't actually have PTO, I likely wouldn't have taken those days off. They say that they are deducting 40 hours worth of wages from my remaining 4 pay checks. I believe it is unfair that they are doing this, given how long they took to find the error.

Do I have any right fighting them in deducting this from my yet to be received wages?
