Dispute With Ex-partner Over Ownership And Return Of A Dog After Breakup

I’m in Arizona and currently involved in a civil case with a former partner regarding ownership and possession of a dog we raised together for several years.
When we separated, my former partner took the dog and moved out. She later claimed that the dog legally belonged solely to her. I disagree and have documentation showing that I was substantially involved in acquiring, paying for, and caring for the dog.
Some of the evidence I have includes:
- Proof that I paid the original adoption fee.
- Veterinary and emergency vet records identifying me as an owner/contact.
- Pet insurance records in my name.
- Boarding/pet-sitting records showing that I regularly arranged and paid for the dog’s care.
- Financial records showing expenses I paid toward the dog.
- Messages between us discussing the dog as being jointly ours.
- Numerous witnesses who can speak to my role in raising and caring for the dog.
- Photos, travel records, and other documentation showing that the dog was treated as part of our shared household for years.
After the breakup, my former partner refused to return the dog and relocated out of state with him. I eventually filed an Arizona civil lawsuit seeking return of the dog and asserting claims including replevin and conversion.
The defendant has answered the lawsuit, and the case is now moving toward the discovery/trial-setting stage. There have also been settlement discussions, but no agreement has been reached.
My main goal is the return of the dog rather than monetary compensation.
I already have an attorney, so I’m not looking for someone here to replace my lawyer. I’m mainly trying to better understand the litigation process and get outside perspectives on a few questions:
- In an Arizona replevin/property case involving a pet, what types of evidence generally carry the most weight when ownership is disputed?
- How important are records showing who actually paid for and cared for the dog compared with whose name may appear on an adoption or microchip record?
- Would Requests for Admission, Interrogatories, or Requests for Production typically be useful in a dispute like this?
- If one party has had exclusive possession of disputed property for an extended period while litigation is pending, does that affect the ultimate ownership analysis?
- Are there any major issues I should be thinking about before the case is formally set for trial?
I understand that pets are generally treated as property under Arizona law. I’m mostly interested in understanding how courts evaluate conflicting evidence of ownership and what discovery tends to be most useful in a case like this.
