Condo Leak From Upstairs Unit Led To Mold Remediation Power Usage, Insurance, And Repair Delays (need Advice)

Hi everyone,

I live in a condo and recently dealt with a water leak from the unit above mine. The leak caused damage in my kitchen area and the adjacent room, and the HOA’s contractor brought in a mitigation company to handle mold remediation.

The remediation is now complete, but the walls and areas they tore down haven’t been repaired yet because the upstairs owner filed an insurance claim with her provider. The claim is still under review, and the HOA manager said they’re waiting for the adjuster to inspect my unit before moving forward.

While the drying and mitigation machines were running in my unit, my AC was shut off and no one was staying there, but the equipment ran continuously. I’ve asked my power company to monitor my electricity usage from the time the equipment was installed to the time it’s removed, because I don’t feel I should be responsible for the additional cost.

The HOA manager mentioned that the issue originated from the upstairs neighbor’s plumbing, and that the insurance claim is being handled by their policy. I’ve been communicating with the property manager and received the contractor’s report, but I haven’t gotten clear information about:

Who is responsible for the increased power bill from the mitigation equipment,

How long repairs might be delayed while the claim is pending, and

Whether I should file my own claim with my condo insurance (HO-6) to protect myself.

Has anyone been through something similar? Should I push for reimbursement for the power usage through the upstairs neighbor’s insurance, or file my own claim and let my insurer handle it through subrogation?

Any guidance or experience dealing with HOAs and insurance in situations like this would be really helpful.
