Cashing Check For Deceased Spouse (california)

Card image cap

Location: California

Hi there. So my mom passed in 2018. She didn’t have a will, but my dad’s name was on all the accounts, house deed, and whatnot. After she passed, my dad and sister switched phone carriers.

My dad just received a check that was issued to my mom as part of a data breach settlement. I’m not sure how my mom’s info got connected there, since they were on a different mobile carrier prior to her death and her cell number was deactivated before they moved carriers. But here we are (don’t look a gift horse in the mouth I say!)

My question is this: is my dad able to just deposit the check? I’ve told him to hold off for now, since the bank my not let him, and that he might want to contact the settlement people to get it reissued. Obviously, a lot of time has passed here. My dad is in his 70s and on a fixed income, and the check is for a couple hundred dollars, so he could use the money or else I’d tell him to just ignore it.

Thanks in advance for any advice you can provide!
