Car Accident…. Well Two

Card image cap

Location: Texas

I have spoken to an attorney but I haven’t signed anything. I’m currently looking for advice.

Last month my daughter & I were in a car accident (not at fault), my daughter was checked out due to head pain but thankfully is fine. I fractured a vertebrae and rib, I also have a lung contusion. I was admitted overnight.

The guy from this accident not only tried running but he also tried lying to the officer about how the accident happened. No tickets were given which really upset me but oh well, I chased him down and made him stop before the officer made it to us.

He’s currently dodging calls from insurance which is really making me nervous. I got my first hospital bill in and it’s $49,600. That doesn’t include follow up visits, the ambulance, my daughter’s bills, etc I’m trying to not panic but that’s a huge bill. (I do have health insurance)

A week after my first accident a girl ran a stop sign while on her phone and I T boned her with both of my kids in the vehicle. The other driver was honest and insurance has already accepted liability. (I was driving my husband’s truck in the second accident)

Thank goodness both kids were fine. I thought I was ok…. I assumed my chest pain and nausea was from me being upset at the time. I went to the ER the next night after the new pain and nausea wouldn’t stop to find out I fractured four more ribs and separated the cartilage in my chest. (At follow up my dr said I also have whiplash)

The attorney I spoke to takes 40% right away, that makes me uncomfortable because in my eyes it’s just going to leave me with even more medical bills to pay. I already think my bills will be more than the policies (I’m a pessimist)

Will the insurance policy cover my medical bills without me getting an attorney as long as I provide proof and it’s all legitimate charges? Or do I need to get an attorney to make sure my medical bills are covered?

I know if my bills are more than policy limits then I’m screwed. I have no idea what either of the other drivers policy limits are. We do have a 50k policy for underinsured motorist.

-We all have the same popular insurance company, I’m not sure if that matters.

-Police report puts the 1st accidents driver completely at fault but I’m waiting for insurance to accept liability.

-Insurance has accepted liability for second accident.

-I was hospitalized overnight for the first accident, I just went to the ER and was released after the second.

-My UIM is 50k for personal injury
