Car Accident Question And Insurance

I was involved in a car accident yesterday between myself and 1 other vehicle. 2 police officers came to the scene and per the “Incident Report” that was given to me at the conclusion by the officer I spoke with and explained what happened, it indicates “Vehicle 1 (the other driver), violated the stop sign and collided with vehicle 2 (me). Which is truthful and exactly what happened. I don’t recall his exact wording but The officer told me that him and the other investigating officer concluded it was the other drivers fault.

This occurred near a gas station with a camera that captured the crash and clearly shows the other driver being at fault. I work a block away so I stopped in today and they showed me the video but not allow me get a copy, whatever no big deal. I get home, file a claim with the other individuals insurance (State Farm).

Here is where the accident gets tricky and hence why I’m posting this and I’ll preface this by saying I have contacted a local attorney already and have a consultation tomorrow.

It came to my knowledge today that I turned auto pay off at some point and therefore I didn’t have active car insurance, despite my insurance card showing it expires in September 2026 and that I gave to the police officer and is also listed on the incident report. Very stupid on my behalf, I get it, so please don’t lecture me about this and what’s done is done and I cannot go back in time and change this.

Also, after the accident took place and I called 911, as I was sitting in my vehicle, a bag of random trash had spilled all over inside my vehicle from the crash and contained some empty alcohol shooters. I cleaned it up and took it to the trash bin in the gas station parking lot. Halfway into the officers investigation and after I gave my statement to the officer, he walked over to me and said a “witness” saw me throw a bag into the trash can. I told him yes, I did. He asked if I had been drinking, I told him no (which I had not been), asked when the last time it was I drank which I told him Sunday. He had me do a HGN field sobriety test, which I did. Once I did that he said hang tight, so I did, and 15 minutes later came back, gave me the incident report, asked if I wanted him to call a tow truck and told me what I said in my first paragraph and that the other officer was writing up the report. Asked how I was getting home and let him know my wife was on her way to come and pick me up. The other drivers vehicle was towed. End of story.

I’m Just curious what to expect moving forward from a legal perspective, as well as the insurance side of it. I was never charged with any crime, nor was I or the other driver injured and no ambulances came.
